Grotius
Hugo Grotius (/ˈɡroʊʃiəs/; 10 April 1583 – 28 Augustus 1645), ook bekend as Huig de Groot (Nederlands: ˈɦœyɣ də ɣroːt) en Hugo de Groot (Nederlands: ˈɦyɣoː də ɣroːt), was 'n Nederlandse humanis, diplomaat, regsgeleerde, teoloog, digter en dramaturg.

Hy is as intellektuele wonderkind gebore in Delft, en het aan die Universiteit van Leiden studeer. Hy is in Loevestein Kasteel gevange geneem vir sy betrokkenheid by die Calvinistiese geskille van die Nederlandse Republiek, maar het ontsnap in 'n kis vol boeke wat na Gorinchem vervoer is. Grotius het die meeste van sy groot werke in ballingskap in Frankryk geskryf.
Hugo Grotius was 'n belangrike figuur in die studievelde van filosofie, politieke teorie en regte gedurende die sestiende en sewentiende eeu. As sulks het hy 'n reuse invloed uitgeoefen op die Romeins-Hollandse Reg, wat vandag in Suid-Afrika toegepas word. Saam met die vroeëre werke van Francisco de Vitoria en Alberico Gentili het hy die grondslag gelê vir die internasionale reg wat gebaseer is op 'n Protestants-gekleurde natuurreg. Twee van sy boeke het 'n blywende impak gehad op die gebied van die internasionale reg: "De jure belli ac pacis" ["Oor die Reg betreffende Oorlog en Vrede"] wat gewy is aan Lodewyk XIII van Frankryk en die "Mare Liberum" ["Die Vrye Seë"]. Grotius het ook bygedra tot die ontwikkeling van die begrip "regte". Voor hom is regte beskou as verbonde aan voorwerpe; na hom is dit gesien as behorende tot persone, dit wil sê, as die uitdrukking van 'n vermoë om regshandelinge te verrig (regspersoonlikheid) of as 'n manier om iets te verwesenlik of aan te gaan soos 'n ooreenkoms.
Peter Borschberg stel voor dat Grotius grootliks beïnvloed is deur Francisco de Vitoria en die Skool van Salamanca in Spanje, wat die idee ondersteun het dat die soewereiniteit van nasies sy oorsprong in die volk het, en nie in konings as verteenwoordigers van God nie. Gebaseer hierop, stem die volk in om sodanige gesag aan hul owerhede, insluitend die konings, toe te ken. [1]
Alhoewel Hugo Grotius nie die eerste was om die internasionale samelewing-leerstelling te formuleer nie, was hy een van die eerstes wat die idee van een samelewing uitdruklik omskryf het, dit wil sê 'n samelewing bestaande uit state wat nie by wyse van mag of oorheersing regeer word nie, maar deur wette en onderlinge ooreenkomste om daardie wette toe te pas. Hedley Bull het in 1990 verklaar: "Die idee van die internasionale samelewing wat Grotius voorgestaan het, het konkrete uitdrukking gekry in die Vrede van Wesfale, en Grotius kan beskou word as die intellektuele vader van hierdie eerste algemene vredeskikking van die moderne tye."[2] Daarbenewens het sy bydraes tot die teologie van Arminianisme daartoe bygedra om die saad te plant vir latere bewegings soos Metodisme; Grotius word erken as 'n belangrike figuur in die Arminiaans-Calvinistiese debat. Vanweë sy teologiese ondersteuning van vrye handel word hy ook as 'n "ekonomiese teoloog" beskou. [3]
Grotius was ook 'n dramaturg en digter. Sy denke het na die Eerste Wêreldoorlog weer op die voorgrond getree.
